Attorney of accused shooter: "It was an accident"

It's a shooting that won't soon be forgotten in the Fern Creek neighborhood, involving 12-year-old Jacob Eberle and 56-year-old Michael Bishop.

�"It's hurtful because we can't get his side out. Jacob is a good boy. He's a straight 'A' student," says Jennifer Mangeot, a close family friend.

Bishop's attorney has this to say about his client.

"He's worked his entire life. They are good Christian people. They are devastated by this," says Brian Butler.

Louisville Metro Police say Jacob and friends were pranking neighbors by ringing doorbells a little before 10:00 on Monday night.

When they got to Michael Bishop's home, that's when police say a shooting happened.

Jacob was hit by a shotshell containing birdshot.

"He actually didn't make it to the door that night. Just made it to the yard before the incident occurred," says Jennifer Mangeot.

"Mike and his family..their hearts and their prayers go out to this boy and his family. Mike didn't intend for this to happen. It was an accident," says Brian Butler, Bishop's attorney.

Brian Butler says in days leading up to this incident, there were other pranks.

"I can say that a lot of this type of activity had gone on in that neighborhood, but getting into specifics, we'd rather not do that at this point given the fact Mike has been charged with a very serious crime," says Brian Butler.

While in the hospital, Jacob has told his father he wasn't involved in other pranks, just this one.

He's now recovering in the hospital with 2 collapsed lungs, and numerous entry wounds.

"It looks like, when you go to a firing range and you just shoot the target and at the end..that's what his back looks like," says Jennifer Mangeot.

The family of Jacob Eberle has now fired back. They've now filed�a lawsuit against Michael Bishop. It demands Bishop pay restitution to the family, including medical expenses.

As Jacob continues to recover, both parties are just wanting to get their message out to the community.

"This was an accident. Mike did not mean to shoot anybody, much less a child," says Brian Butler.

"Accident or not, it's horrible what happened," says Jennifer Mangeot.

Michael Bishop is charged with attempted murder. He is scheduled to be in court Friday morning.
