WACO - An investigation by the Texas�Attorney General's�office�has a Waco lawyer facing felony charges, accused of swindling two elderly people out of more than $100,000.
Waco attorney Ray Rushing, along with Melissa Adler, were indicted Wednesday for their roles in an alleged plot to steal the estate of Eugene Handley.
According to the indictment, Rushing convinced the elderly Handley to sign his estate over to Adler, cheating his rightful heir Jean Tarlton How out of more than $100,000.� Following the transaction, Adler�allegedly�paid Rushing $5,000 from the Handley estate.
In order to do it, the indictment says the two knowingly secured the execution of an order probating a will and authorizing letters testamentary by deception from McLennan County.
Both are charged with two counts of misapplication of fiduciary property, theft of an estate and securing execution of a document by deception.� Each are charged with a state jail felony, punishable by up to two years in prison, and three second degree felonies carrying possible penalties�of from two�to 20 years in prison.
In a statement to News Channel 25, Rushing says, "I'm denying the charges and�I look forward to having my day in court, when�I can present my case and clear my name."
