Police: Drunken Driver Runs Over Officer

An Albuquerque police officer was hit by drunken driver Sunday night, according to police.Police said Officer Justin Montgomery was patrolling near Third Street and Central Avenue on his bike Sunday when he stopped a car that was driving with no headlights.The driver, Benito Aragon, was believed to be drunk, according to police. Police said Aragon started to drive away, dragging Montgomery alongside his car. The officer was able to break free, but the car's back tire ran over his leg. Montgomery was taken to University of New Mexico Hospital, where he's in surgery.Aragon was arrested and charged with great bodily harm by vehicle and eluding police.

Secretary of state 'shocked' by pedestrian death

SANTA FE, N.M. (AP) - Secretary of State Dianna Duran says her car was one of several that struck a man's body on a highway near Santa Fe after the pedestrian had been hit and killed a short time earlier by another vehicle.

Duran issued a statement Friday saying she was "shocked and saddened" over the accident and expressed her "thoughts and prayers" to the family of the victim.

Santa Fe police say a man was killed while walking along New Mexico Route 599 Thursday night.

Several other vehicles then struck the body while it was in the road.

Duran said she was on her way home about 7:30 p.m. when she ran over what "appeared to be an animal that had been struck" in one lane of the highway.

The University of New Mexico has hired former Notre Dame coach Bob Davie to head up its troubled football team.Vice President of Athletics Paul Krebs announced the appointment Wednesday. UNM has scheduled a press conference Thursday afternoon to introduce Davie, who will become the university?s 31st head coach.As head coach at Notre Dame, Davie went 35-25 and advanced to three Bowls, including one BCS Bowl (the 2001 Fiesta Bowl). ?Occupy Socorro? To Hold Protest in City Plaza

SOCORRO (AP)�? Members of Socorro?s version of the national protests against Wall Street are slated hold their own protest in the city?s plaza.

Organizers announced that protesters are scheduled today to hold a rally joining�?Occupy? protesters in other New Mexico towns and cities.

?Occupy Santa Fe,? for example, has planned a series of teach-ins Sunday at it permanent protest encampment site at the Railpark.

In addition, members of�?(Un)Occupy Albuquerque? are slated to hold a�?mock auction? of foreclosed homes next week on the steps of a courthouse in downtown Albuquerque.

Other upcoming�?Occupy? events are planned in Espanola and Farmington.

Berry Signs Bill To End Red-Light Camera Program

Albuquerque Mayor Richard Berry signed several pieces of legislation Thursday, including the bill that ends the city's controversial red-light program.In October, residents voted against the red-light camera program in a non-binding ballot initiative. Earlier this month, the city council drafted the legislation to put an end to the camera system.Target 7 was the first to uncover the financial failures of the red-light camera system, showing that the program cost taxpayers as much as $100,000 each month.
  • Other legislation signed by the mayor on Thursday:
  • $100,000 from the Albuquerque Business Education Compact to plan and implement an "Anti-Heroin" initiative for children.
  • $1.5 million grant for Mayor's Homeless Initiative "Albuquerque Heading Home"

Water worries for New Mexico farmers

The Rio Grande runs drier through irrigation of New Mexico farms each day.

Only four inches or irrigation water is expected for farmers south of Elephant Butte Dam this year. Many farmers in the Elephant Butte area are expecting even less next year.

What?s worse, many small farmers in the area do not have access to agricultural wells to pump ground water.

Some worry that the dry soil will absorb water, whenever it reaches the dirt, before it ever streams to the Rio Grande.

UPDATED: Man, 25, Sentenced in Shiprock Stabbing

Lukacema Gillie Yazzie, a 25-year-old enrolled member of the Navajo Nation, was sentenced in federal court in Albuquerque Wednesday to 18 months behind bars plus three years of supervised release in connection with a stabbing in Shiprock last December, the U.S. Attorney?s Office said.

Yazzie, who has been in federal custody since his arrest on Dec. 13, 2010, also was ordered to pay $10,008 in restitution to the U.S. Department of Health and Human Services and $130 to the victim of his assault, federal prosecutors said in a news release.

He pleaded guilty on June 13 to a charge of assault with a dangerous weapon and admitted as part of a plea agreement to stabbing a member of the Mescalero Apache tribe in Shiprock on Dec. 8, 2010, according to the news release.

2:41pm 6/14/11 ? Navajo Man Pleads Guilty to Federal Assault Charge

A 24-year-old Navajo man accused of stabbing a man last year in Shiprock has pleaded guilty in federal court in Albuquerque to an assault with a dangerous weapon charge under a plea agreement with the U.S. Attorney?s Office.

Lukacema Gillie Yazzie, under the terms of the plea agreement, will be sentenced to 18 months in prison followed by not more than five years of supervised release, the U.S. Attorney?s Office said in a news release announcing that Yazzie had entered the guilty plea Monday.

A date for a sentencing hearing was not immediately set for Yazzie, who has been in federal custody since his arrest on Dec. 13, 2010, and will remain in custody pending the sentencing hearing, according to the news release.

The news release said Yazzie pleaded guilty to stabbing a member of the Mescalero Apache Nation on Dec. 8, 2010, in Shiprock, which is on the Navajo reservation.

Yazzie was charged with assault with a dangerous weapon in a criminal complaint on Dec. 13, 2010, and was indicted on the same charge on Dec. 28, 2010. He admitted in his plea agreement that he committed the assault charged in the indictment, the news release said.

Homeless woman: Starving dogs were taken care of

KOB Eyewitness News 4 is hearing from a dog owner accused of trapping her animals in her house without food or water.

Last week KOB aired photos of the starving dogs and the deplorable conditions they were living in.

The photos show dog feces, dried up urine and trash everywhere in the foreclosed house located near Juan Tabo Boulevard and Candelaria Road NE.

The city said it appears two dogs trapped there for more than a month.

The deed is registered John Williams who also goes by Vanessa Gutierrez.

Guiterrez called KOB saying after losing her job and about everything else - she had no choice but to keep the dogs at the house.

"I had no place to stay, I couldn't stay with my friends because of the dogs so I took the dogs there where they'd be safe and I was out here on the street," Gutierrez said.

She claims the dogs were living in better conditions than she was while on the streets.

"They hadn't even been there two or three days, I was going everyday taking them food, water - hanging out with them for a little while," Gutierrez said.

Assistant City Attorney Greg Wheeler said that is not true and the evidence proves it.

"It was horrific. There was trash all over the floor, there was dog feces all over the floor," Wheller said.

Gutierrez claims the house had been previously ransacked, and she was trying to clean it up.

The city went into the home and seized the dogs last week after neighbors complained about constant howling they said was heartbreaking.

"The bigger dog--you could count the ribs on the animal. It had not been taken care of," said Neighbor Ruth Patterson.

Gutierrez said these two dogs are her world and she would never do anything to hurt them and in fact she wants them back.

"I've lost my home, I've lost my job, I've lost my belongings - I lost everything, what do they want, my life next?" Gutierrez said.

Gutierrez has not yet been charged but could soon felony charges for extreme cruelty to animals.

PETA compares dogs to turkeys in new Thanksgiving campaign

The group, People for the Ethical Treatment of Animals, or PETA, is talking about putting up a billboard near an Albuquerque school to convince children not to eat turkey on Thanksgiving.

The billboard PETA wants to display reads, "If you wouldn't eat your dog, why eat a turkey." It features a picture of a turkey-dog combo.

KOB Eyewitness News 4 visited a local dog park to see what Albuquerque residents thought.

"I find it very offensive they would put up a billboard of any kind saying if you wouldn't eat your dog you shouldn't eat a turkey," said Joyce Similar.

A man in the park told KOB there is a big difference between a dog and a turkey.

"I mean, turkeys are generally accepted as edible," Josh Feummeler said.

Similar elaborated on her response.

"A dog is a member of most people's families and you're certainly not going to eat your own family. Whereas a turkey, you go to the local shop and you purchase the bird and eat it. It's not like it's a family member at all."

KOB talked with a member from PETA who said they are having a hard time finding billboard space in Albuquerque. They do not know if they message will be posted.

PNM to shut down payment centers statewide

It is going to start costing you a little extra if you use cash to pay your PNM bill. The company is shutting down all of its payment centers statewide next month.

Customers can still pay with cash through Western Union, but they will have to pay a service fee.

The PNM payment center in downtown Albuquerque will be the last of eight to shutdown statewide.

On December 21, the doors will close for good.

"Accepting payments in person is the most expensive way we have of taking payments - it cost about ten times more than other payment methods," said PNM spokesperson Valerie Smith.

PNM says only 10 percent of their customers still prefer face-to-face service.

Now those customers will have to either go to Wells Fargo to pay by check or Western Union to pay by cash.

Western Union is charging a dollar as a bill pay service fee.

PNM is arguing that is a small price to pay.

"You do get the added convenience of having longer hours and better parking and so for a lot of them just the savings on parking and gas makes up for the bulk of the dollar," Smith said.

Cash user Lanette Padilla found out about the closures Monday and she is not happy.

"One dollar to me is a little bit more towards my gas tank," Padilla said.

It does not matter to Rubert Valdez who said he will just use the mail.

"I like to come in here because I like to come downtown and other than that it doesn't matter," Valdez said.

Jonathan Gonzalez worries about the 15 PNM employees who will be out of a job right before Christmas.

"Out of those 15 people, how many of them have families and kids?" Gonzales asked.

PNM said anytime is a bad time for layoffs, but they are trying to soften the blow to employees.

"We are doing what we can to ease the transition - they will get a competitive severance bonus to hopefully bridge them to the next job," Smith said.

PNM said they will save over $500,000 a year by closing their pay centers. Despite their new-found savings, they are not saying anything about reducing rates.

Suspected DWI Driver Refuses To Release Kids' Remains

A Valencia County woman is fighting to be able to bury her grandchildren, who were killed in a crash last week.Police said the children's father, James Woolbert, was driving drunk. Woolbert is recovering at the University of New Mexico Hospital.Officers said Woolbert will be arrested as soon as he's released from the hospital, but the children's grandmother said Woolbert refuses to let her have the remains so she can set up their funeral."I'm thinking I'm going to wake up. I'm going to wake up. It's all going to be a nightmare," said the children's grandmother, Pauline Jaramillo.Jaramillo's grandchildren, 4-year-old Marissa and 2-year-old Michael, died when they were thrown from a car during a crash in Meadowlake on Wednesday. Investigators said the children weren't in the car seats."They were my babies. I raised those babies. I gave them everything they needed," Jaramillo said.Jaramillo said she wants to give the children a proper funeral, but Woolbert won't let her do it. Woolbert has custody of the children because their mother, Dawn, also died in the crash."They need to be buried. They need to be put to rest. They're in a refrigerator. They're in a cold refrigerator," Jaramillo said. "I can't even tell you how angry I am."Jaramillo said she got a lawyer involved, hoping she can get the remains because there's no telling if or when their father will get out of jail after getting treated at the hospital for injuries."I'm sorry he didn't die, but I hope he suffers for the rest of his life and he never gets out of prison," Jaramillo said.

A story of those who gave, received the gift of life

It's something many of us haven't given much thought to: donating our organs when we die.

But did you know, one organ donor can save or help the lives of dozens�of people?

Sam Grant, 25, will tell you just how much organ donation has helped him.

When he was 17 years old he was diagnosed with Alport's syndrome.

"Alport?s syndrome is a genetic disease of the kidney which causes degeneration of the kidney over time," Sam says.

As a teenager, Sam didn't think much of his diagnosis until he went into renal failure.

Sam says, "My doctor told me point blank, if you don't get a transplant by the time you're 30 you are going to die."

He got the transplant in 2009.� It happened 10 days after his daughter Niki was born.

"I didn't think I was going to live to see her grow up and watching her grow and watching her learn and watching her play in the living room right now is just the greatest feeling of joy that I can experience," he says.

Sam's kidney donor was his uncle, Larry Harris, a paramedic in North Richland Hills, Texas.

"He's been a paramedic for 25 years. He's a big inspiration to me. He's one of the reasons I became a paramedic," Sam says of his uncle.

While Sam's was a living donor, that's not always the case.

KOB reporter Sharon Fullilove, known on-air as Sharon Erickson, signed up to be an organ donor years ago when she got a driver's license in Texas.

Sharon passed away in September after complications with surgery, so it's still too early to know how exactly her legacy lives on in terms of her organ donation.

We do know, however, that one person's organs can save up to nine lives.

Their tissue and bones can help improve the lives for as many as 50 people.

Like Sharon, 4-year-old Matthew Comfort was a deceased donor.

He died from a head injury he suffered in the bathtub.

Matthew's father, David Comfort says, "When a parent loses a child it?s a pain that no one should have to endure. It leaves a hole in your life that is never filled. It's something you remember forever."

David says donating Matthew's organs was a decision that meant other parents could be spared his pain.

"It was the easiest decision I had to make, to know that I could save another parent from feeling the same grief, it was the easiest decision I had to make," David says.

For Sam Grant, organ donation means his 2 year old daughter, Niki, will grow up with her dad.

"I love her so much. She's probably the best thing that happened to me, transplant is number two. A close number two."

More than 100,000 people need an organ transplant right now.

Each year, thousands die because an organ donor isn't found in time.

New Mexico Donor Services says about 50% of New Mexicans with drivers licenses are signed up to be organ donors but there is still a great need.
