Davis attorney suspended in foreclosure evictions probe

DAVIS, CA - An attorney with a notorious reputation among tenants' rights advocates has been suspended by the California State Bar for using non-attorney staff toevict renters living in foreclosed homes.

David Endres has been ordered not to practice law for six months and to reimburse the State Bar $4,000 for the cost of the investigation and suspension proceedings.

According to the statewide renters' rights organization known as Tenants Together, Endres has filed thousands of eviction cases on behalf of major banks targeting tenants whose landlords had stopped paying their mortgages.

Tenants Together said many of the evictions violated federal, state and local law.

News10 reported on one Endres-filed case in Roseville, where a tenant was ordered to leave her home despite having a valid lease with the homeowner.

The State Bar determined Endres filed more than 1,000 eviction cases in one six-month period in 2009 and used non-attorney staff to accomplish the task.

Tenants Together welcomed the news of Andres' suspension, but called for even stronger sanctions.

"David Endres should be disbarred, if not put in jail," said the organization's executive director, Dean Preston, in a news release.

"I'd like to see him lose his law license and be forced to compensate all the tenants whose homes he seized improperly," Preston said.

  1. Borrowers who seek foreclosure help early are much more likely to work out a solution, no matter how dire their situation. Based on your situation, your lender may be able to provide the foreclosure help that you need.
