Attorney: Dippolito Didn't Get Fair Trial - msnbc.com

A Boynton Beach woman who was found guilty of hiring an undercover officer to kill her husband wants a new trial.

An attorney for Dalia Dippolito filed the motion last month, claiming his client didn't get a fair chance.

The argument centers on Dippolito's ex-boyfriend, Mohamed Shihadeh.

Shihadeh, who tipped off police about the plot, pre-recorded his testimony for the trial because he claimed he was going to be out of the country, but he was arrested on a DUI charge in Boca Raton while the trial was ongoing.

Dippolito's attorney argued his client has a right to face her accuser in court.

Last month, a jury convicted Dippolito of solicitation to commit first-degree murder.

Dippolito was arrested in August 2009 after she hired an undercover police officer who was posing as a hit man to kill her husband, Michael Dippolito. Police then staged a crime scene and recorded her reaction on the day the killing was supposed to take place.

She remains in jail while awaiting sentencing.
