NY attorney general seeks $2B recovery from Mellon ? AP ? msnbc.com

New York Attorney General Eric Schneiderman sued Bank of New York Mellon for $2 billion on Tuesday, claiming it earned that amount over 10 years by defrauding clients in foreign currency exchange transactions.

According to Schneiderman?s office, BNY Mellon misrepresented rates it would give currency transactions, providing nearly the worst rates of the trading day instead of the best. The case began with a 2009 whistle-blower complaint followed by an investigation. Clients include public pension funds.

New York City joined in the lawsuit. Deputy Comptroller Ricardo Morales said officials are confident pensioners and taxpayers will recoup money they are owed.

The bank said the lawsuit was??prosecutorial overreach? based on??a fundamental misunderstanding? of the role of custodian banks in the global foreign currency market. BNY Mellon said it is confident it will prevail in the suit, which was filed in state Supreme Court in Manhattan.

On the same day, the U.S. Attorney for the Southern District of New York also announced it had filed a civil fraud lawsuit in Manhattan federal court against the bank, alleging BNY Mellon engaged in a scheme to defraud custodial clients who have used the bank?s foreign exchange services from at least 2000 to the present.

The suit seeks injunctive relief and hundreds of millions of dollars in civil penalties under the Institutional Reform, Recovery and Enforcement Act of 1989, according to the U.S. Attorney?s Office.

BNY Mellon spokesman Kevin Heine said the bank is confident it provides its institutional clients and their investment managers with??competitive and attractive? foreign-exchange pricing, the information they need to make informed trading decisions.

Halloween checkpoints pick up costumed DWI offenders

Drinking and driving on Halloween is so common even a cave man can do it.

This weekend?s Halloween festivities were less of a kid?s candy fest and more of an adult party.�

With adult parties comes alcohol. With alcohol comes DWI's and police arrested at least one man who was dressed as a caveman.�

Police agencies were out in force looking for possible drunk drivers and many in costume were forced to take sobriety tests with varying results.

By midnight Albuquerque Police Department officials said 10 people were arrested at their sobriety check point. Police stopped people in a variety of Halloween apparel.

One man was pulled over after riding his horseless carriage from downtown.

Even a man dressed as Dog the Bounty Hunter was also pulled over.�

Former Santa Fe Sheriff Gets Out Of Jail

Former Santa Fe County Sheriff Greg Solano is out of jail.The former lawman has spent the last six weeks in jail for selling off government property and keeping the cash. Solano had been sentenced to three months behind bars, but good behavior cut the time in half.He was released Friday morning. But for the next nine months he?ll have to wear an electronic bracelet and can only go between work and home.Solano was sentenced in September for ripping off the county by selling bullet proof vests and other country property on E-Bay. He pocketed about $75,000 from the sales.Solano will also have to pay about $25,000 in restitution to Santa Fe County.

UNM football falters; XC and soccer teams win conference titles

It just keeps getting worse for the University of New Mexico football team.

Lobo football fans might have thought last week's huge 69-0 loss to TCU was rock bottom for the program, but the Lobos keep reaching further down.

Saturday, UNM was shutout 42-0 by Air Force.

It was a dismal turnout at University Stadium, but those who did show, and stayed, still have high hopes for this football team.

As of Friday night, UNM officials said it had sold more than 15,000 tickets. Less than half University Stadium's capacity.

Still though, there was a decent amount of cherry in the crowd even though the Lobos were playing the Air Force, a team with a built-in fan base in Albuquerque.

Fans who managed to stay for the entire beat down actually said it could have been worse.

"The whole season doesn't sit well with me or most fans as you can tell by the attendance. But, hopefully we're moving in the right direction," David Flanery said.

Another Lobo fan said, "Well, it could have been worse. We could have been 84 instead of 42, or whatever it was."

This was the Lobos eighth game this season, and their eighth loss.

In fact, the closest the Lobos have come to a win was against Division II team, Sam Houston State, back in�September.

They lost in overtime by a field goal.

But it?s not all bleak for UNM athletics.

On Saturday, the UNM men?s and women?s cross country teams ran away with the Mountain West Championship.

On Friday the men and women's soccer teams took their conference titles.

The men?s team is ranked number one in the nation in some polls.

Another good note for Lobo fans, basketball season starts on Tuesday.

Albuquerque police officers hospitalized after meth lab bust

A Northeast Heights apartment complex was evacuated after Albuquerque Police said a unit erupted in smoke from a meth lab.

The incident happened at the Hillcrest Apartments near Montgomery and Carlisle on Friday night.

Two police officers were sent to the hospital because they were exposed to the chemicals inside the lab.

The officers were complaining about itchy throats and burning noses.

Police called the scene a shake and bake meth lab because all the ingredients were combined inside a two liter plastic bottle.

This was one of the first shake and bake labs APD has seen in the area.

Police originally responded to the scene after a disturbance call.

When they arrived they could see the meth lab inside the apartment.

Duane Wendt, 32, was arrested after he admitted to police he was making the meth to supply his habit.

He reportedly told police he shoots a gram every 12 hours.

One man dies in fatal South Valley crash

One man is dead and several people are injured after a Friday night crash involving two vehicles in the South Valley.

According to the Bernalillo County Sheriff?s Office, around 8 p.m. a Nissan Altima slammed into a white Monte Carlo near the Wal-Mart at Rio Bravo Boulevard and Coors Avenue.

A passenger in the Monte Carlo, a male in his 20s, was killed.

?It looks like the white Monte Carlo probably turned left in front of the oncoming gray Nissan Altima,? BCSO Lt. Pat Charlton said. ?The Altima was eastbound and hit it about the middle of the door, which is where the deceased person was sitting.?

It appears the driver of the Monte Carlo made a bad driving decision, authorities said.

So far alcohol does not appear to be a factor in the crash.

Police said that one injured person had a serious compound fracture.

The injured people are at the University of New Mexico Hospital.

A New Mexico resident dealt with the loss of a furry friend by shipping the dog?s DNA overseas and having a clone made.Blue sure looks like a normal 12-week-old half Mastiff,half Great Dane puppy, but he?s not.?He has a great personality, but this a special situation,? veterinarian Dr. David Caffey said. ?It?s a new copy of the old one.?The pup is a carbon copy of Old Blue, who passed away a few years ago. He is one of an estimated seven clone dogs living in the United States. The clone is a $100,000 investment that puts the idea of pure breeding to shame. ?Breed them, and try to get a litter where a puppy would be similar. This is closer to similar; it's an identical copy,? Caffey said.Before the original Blue died, the owner had the dog?s DNA shipped overseas to South Korea for cloning. South Korea has become the cloning capitol of the world. Dozens of cloned dogs are produced there, and a group of cloned golden, lab retrievers now patrol Korea?s Incheon Airport.Caffey treated the original dog and the clone. He said the clone is perfectly healthy.?(He?s) an identical copy of the original version,? Caffey said.

AFD firefighter facing rape allegations

An Albuquerque firefighter who also is the fire union?s Chief Steward is under investigation on suspicion of criminal sexual penetration.

KOB Eyewitness News 4 was first to report that a 44-year-old woman told police that she had a few alcoholic drinks then fell asleep.�

She claims Lt. Robert Lujan, a firefighter since 1997, sexually penetrated her with objects from a child's game while she slept.

A police incident report states that the woman complained of abdominal pain.� She told police she went to the doctor where the objects were removed and discovered she also had an infection.�

AFD Chief James Breen told KOB that he placed Lujan on administrative assignment working in the fire supply room immediately after learning of the police investigation.

?The fire department is doing its due diligence in removing Lujan from providing emergency services and having direct contact with the public,? Breen said.�

But Breen and City of Albuquerque Chief Administrative Officer Rob Perry said they want Lujan to be removed from his position in the fire union IAFF Local 244 until the criminal investigation is completed.�������

?The City?s concern is that Lt. Lujan represents the entirety of the union and that he is the face of the Albuquerque Fire Department,? Perry said.�

As Chief Steward, Perry and Breen said that Lujan continues to represent union members during disciplinary procedures and carries all of the responsibilities of that position, despite the allegations.

Local IAFF 244 President Diego Arencon told KOB that Lt. Lujan is entitled to due process like any other fire employee.

Ryan Villa, an attorney representing Lujan issued this statement: ?Based upon our investigation of the case, we believe these allegations are completely baseless. The allegations were made to the police over 14 months after the incident supposedly occurred. We look forward to being able to present all of the facts and circumstances surrounding this case and being able to show that (Lujan) is completely innocent of these charges."
